2. Предмет соглашенияSubject
ToptodayAI предоставляет доступ к цифровым товарам (шаблоны, промпты, инструкции, воркфлоу автоматизации), онлайн-курсам и марафонам, SaaS-сервисам (реклама, лид-хантер, поиск блогеров, HR-подбор), а также оказывает услуги по настройке автоматизации, созданию сайтов и SEO-продвижению.ToptodayAI provides digital goods (templates, prompts, guides, automation workflows), online courses and challenges, SaaS services (ad generation, lead hunter, blogger outreach, HR matching) and done-for-you services: automation setup, landing pages and SEO promotion.
Соглашение действует для всех продуктов, товаров и услуг, опубликованных на toptoday.pw, в том числе на страницах /pay и /store, а также для партнёрской программы.These Terms apply to every product, good and service published on toptoday.pw, including the /pay and /store pages, and to the partner programme.
Мы можем изменять состав, функции и цены продуктов; уже оплаченный заказ исполняется на условиях на момент оплаты.We may change the product line, features and prices; a paid order is honoured on the terms in force at the time of payment.

Названия и состав пакетов могут уточняться без ухудшения уже оплаченного заказа.The current list with prices and payment methods is always available at /pay. Package names and contents may be refined without worsening a paid order.
4. Аккаунт и регистрацияAccount & registration
Часть функций требует аккаунта. Вы обязуетесь указывать достоверные данные и не передавать свои учётные данные третьим лицам.Some features require an account. You agree to provide accurate data and not to share your credentials with third parties.
Мы вправе ограничить или удалить аккаунт при нарушении настоящих условий, попытке злоупотребления или мошенничества.We may restrict or delete an account in case of breach of these Terms, abuse or fraud.
5. Допустимое использованиеAcceptable use
Запрещено использовать сервис для спама, рассылки незапрошенных сообщений в нарушение применимого законодательства, мошенничества и нарушения прав третьих лиц.You may not use the service for spam, unsolicited messaging in breach of applicable law, fraud or infringement of third-party rights.
Запрещено пытаться получить несанкционированный доступ к инфраструктуре, обходить лимиты и ограничения безопасности.You may not attempt to gain unauthorised access to the infrastructure or bypass limits and security controls.
6. Интеллектуальная собственностьIntellectual property
Все материалы, шаблоны, тексты и код принадлежат ToptodayAI или соответствующему лицензиару.All materials, templates, texts and code belong to ToptodayAI or the respective licensor.
При покупке вы получаете личную неисключительную лицензию на использование продукта. Перепродажа, публикация в открытый доступ и распространение без письменного разрешения запрещены.On purchase you receive a personal, non-exclusive licence to use the product. Resale, public disclosure and redistribution without written permission are prohibited.
7. Цифровые товары и доставкаDigital goods & delivery
Доступ к цифровому товару предоставляется сразу после подтверждения оплаты — письмом на указанный email и/или в личном кабинете.Access to a digital product is provided immediately after payment confirmation — by email to the address given and/or in your account.
Покупатель отвечает за корректность указанного email. Если письмо не пришло — проверьте «Спам» и напишите нам.The buyer is responsible for the accuracy of the email address. If the email did not arrive, check Spam and contact us.
8. Курсы и онлайн-программыCourses and online programmes
Доступ к материалам курса предоставляется на срок, указанный на странице курса. Материалы предназначены для личного использования; запись, перепродажа и публичное распространение запрещены.Access to course materials is granted for the period stated on the course page. Materials are for personal use; recording, resale and public distribution are prohibited.
Курс считается начатым с момента открытия материалов или старта потока. Прогресс и результаты зависят от выполнения заданий; мы не гарантируем трудоустройство или конкретный доход.A course is deemed started when the materials are opened or the cohort begins. Progress and results depend on completing the assignments; we do not guarantee employment or any specific income.
9. Услуги и работыServices and deliverables
Состав, сроки и стоимость услуг (автоматизация, сайты, SEO и комбо-пакеты) фиксируются в заказе или счёте. Работы выполняются по этапам, согласованным с клиентом.The scope, timeline and price of services (automation, landing pages, SEO and combo packages) are fixed in the order or invoice. Work is performed in stages agreed with the client.
Клиент предоставляет материалы и доступы, необходимые для работы, и несёт ответственность за их законность. Сроки сдвигаются на время ожидания таких материалов.The client provides the materials and access needed for the work and is responsible for their legality. Deadlines shift by the time spent waiting for such materials.
Результат услуги считается принятым, если в течение 5 рабочих дней после уведомления о готовности клиент не направил мотивированные замечания.A deliverable is deemed accepted if the client does not send reasoned comments within 5 business days after being notified that it is ready.
10. Подписки и SaaSSubscriptions and SaaS
Доступ к SaaS-сервисам (TopToLead, TopToAds, HR Career Assistant) предоставляется на оплаченный период: месяц, 3 месяца или иной срок, указанный на /pay.Access to SaaS services (TopToLead, TopToAds, HR Career Assistant) is provided for the paid period: one month, three months or another term stated on /pay.
Если на странице продукта прямо не указано иное, подписка не продлевается автоматически: следующий период оплачивается отдельно. Сервис может развиваться, функции могут добавляться или заменяться равнозначными.Unless the product page expressly states otherwise, a subscription does not renew automatically: the next period is paid separately. The service may evolve and features may be added or replaced with equivalent ones.
11. Партнёрская программаPartner programme
Партнёр получает вознаграждение за оплаты, совершённые по его реферальной ссылке, в размере, указанном на странице /partners. Начисление происходит после подтверждения оплаты и окончания срока возврата.A partner earns a reward for payments made through their referral link at the rate shown on /partners. The reward accrues after payment confirmation and the end of the refund window.
Запрещены саморефералы, фейковые аккаунты, спам и накрутка. При нарушении вознаграждение аннулируется, аккаунт может быть ограничен.Self-referrals, fake accounts, spam and artificial inflation are prohibited. In case of breach the reward is cancelled and the account may be restricted.
12. Ограничение ответственностиLimitation of liability
Сервис, цифровые товары, курсы и услуги предоставляются «как есть». Мы не гарантируем конкретный коммерческий результат от их использования.The service, digital goods, courses and services are provided "as is". We do not guarantee any specific commercial result.
Совокупная ответственность ограничена суммой, фактически уплаченной вами за соответствующий продукт.Our aggregate liability is limited to the amount actually paid by you for the relevant product.
13. ВозвратыRefunds
Порядок возврата цифровых товаров, курсов, услуг и подписок описан в Политике возврата и отмены.Refunds for digital goods, courses, services and subscriptions are governed by the Refund & Cancellation Policy.
14. Изменение условийChanges
Мы можем обновлять настоящее Соглашение. Актуальная версия всегда доступна по адресу /legal/terms.We may update these Terms. The current version is always available at /legal/terms.
15. Применимое правоGoverning law
Применимое право и подсудность определяются законодательством страны регистрации Продавца. До обращения в суд стороны стараются урегулировать спор переговорами.Applicable law and jurisdiction follow the law of the seller's country of registration. Before going to court the parties will attempt to settle the dispute by negotiation.
